Last night I was in a hurry to get home and got pulled over for speeding while I was Casual Carrying my XD 40 holstered on my right hip. I was lucky to be close to home and it was a local LEO. He also pointed out that my plates expired last month and I was not wearing my seat belt. Oh yea I also did not have proof of insurance with me... I know I know... ALL stuipd mistakes... but whatever....

So he takes my drivers license back to his squad and comes back and says that because I was so close to home, and local (small town) he was just going to warn me this time. He then told me to be more carefull, put on my seat belt and have a nice night.

Oh yea... the Casual Carry never got brought up... He did not ask, I did not offer.... I went on my way without him even knowing I was carrying....

I have gotten a warning for expired registration, but that was the only thing that was wrong. The officer laughed when I slapped my forehead, exclaiming the notice was buried on my desk and I just forgot.

I have gotten a warning for excessive speeding. My mother was flown to LaCrosse after a work accident and that is where I was headed.

Never done all three and got a warning. Are your knees still clean. :uhoh: Sorry, that slipped.

I have never been asked for proof of inusrance and I have never been caught not wearing my seatbelt.

I gotta move to a place like that, or at least import a bunch of cops like that to this town.

Sounds like maybe he has the brains to figure out who & what is worth the effort & what's penny-ante stuff.
Either those, or your small town has more serious crime to keep officers busy than this big city does.

Yep... I am sure if it happened somewhere else I would have had a few tickets. I am friendly to the local LEO and some know me from past meetings (had my fingerprints taken at the local PD for my Utah Permit, and attend most town hall meetings).. I usually smile and waive when I pass them on the street...

Yep... Sure love small town livin.... Total population almost 2500.....

Oh yea... BROKENCOCKET........ .... sorry that slipped....:D lol

Outdoorsman1

Edited to add.... My point in posting was that I was faced with multiple tickects, but the fact that I was carrying a firearm was not even part of the equation. So I am saying while carrying, if they don't ask, then don't tell...

Exactly...

And my position all along has been that not all LEO are out to give you a hard time or trap you into something by pretending to be friendly... Agreed it is their job to "do whatever it takes" to make a determination as to the severity of any situtation during a citizen encounter. In this case a determination was made that issuing tickets (or searching my vehicle) was not nessesary. I was never even asked to get out of the car...

So in some circumstances I guess it pays to be LEO friendly...

Just Sayin...

I always try to be LEO friendly by minding my own business and refraining from breaking laws. The problem comes in at the times they decide not to be citizen friendly, like when we exercise our rights in a passive or active polite manner. You exercised your right not to notify the LEO that you were carrying a firearm. If he had asked what would you have done? Would it have turned out differently? IMHO, you did well not to say a thing. It was none of his business and it only would have had the possibility of exacerbating the situation.

Krause was being LEO friendly by legally planting a tree in his yard.
Springfield was being LEO friendly by not breaking any laws on his front porch.
The Madison 5 were being LEO friendly by lawfully eating at Culvers.
MKEgal was being LEO friendly by minding her own business in a private parking lot.

If he had asked I would have told him the truth... that I was legally carrying a firearm as I had my WI CCW License with me. How it would have progressed from there I will never know. My gut feeling is that it would not have been an issue as I would have been happy to show my CCW License if asked to do so (as required by law).

As far as LEO friendly, I was refering more to being friendly on a daily basis with local LEO as in a smile or a waive in passing or even (God forbid) friendly conversation at a town hall meeting....
And seein's how we have maybe 4-5 LEO's in our small town, by being "friendly" as discribed above, you get noticed and eventually remembered.

Just sayin...

But, make no mistake, if any of them tried to infringe on my rights, my friendliness would end real fast..

This is what I do in my smallish town. I figure 50 friendly waves to a LEO as we pass on the street is equal to one warning instead of a ticket. Seems to have worked so far....

This isn't targeted at you Outdoorsman, just an opportunity for me to think out loud.

If he had asked I would have told him the truth... [snip]

Me too! Absolutely, you should never lie to the cops; but the real truth is that it's none of his business. :D

However; seeing as even politely implying the above probably would have put him in the mood to write some tickets, everyone will have to choose for themselves. See, that's the problem though. It should be the one ASKING a question that isn't his/her buisness feeling the shame for asking; not the target of the question. The questioner is the one being impolite. Think about it: If I went up and asked some random woman if she was wearing underwear today and she told me "it's none of your business"; is SHE the one being rude? I'd be lucky to get off that easy! So why are WE getting nailed for "contempt of cop" all the time when they're the ones who really deserve the scorn for asking stupid questions in the first place.

In fact, I think that next time a cop asks me if I'm carrying I'm going to turn right around ask them if they are wearing Superman undies. When they tell me it's none of my business, I'll say; "Well, there ya go".

Actually the law is Wisc. Stats. §175.60(2g)(c) ... a licensee who is carrying a concealed weapon shall display his or her license document and photographic identification card ... to a law enforcement officer upon the request of the law enforcement officer while the law enforcement officer is acting in an official capacity and with lawful authority.

A traffic stop per Wisc. Stats. §345.22 Authority to arrest without warrant, and § 345.23 Officer’s action after arrest without a warrant, does not provide cause for a violation of one's Fourth Amen. rights and does not provide lawful authority to request or demand anything.

SAME HERE!

I've been pull over three times for speeding. The first time I deserved it-KIND OF. I was doing 70 in a 55 on the interstate, but it was one of those areas where the speed limit drops quickly from 70 to 60 to 55 when you come into the city. JCPD love it.

But the other two times, I wasn't even going over 50. Once was in the middle of nowhere where the limit is 30. It's through a big open area with nothing but farm land on each side of the road. Even 40 feels like I'm crawling through there. Got nabbed doing 46. The other time was, once again, coming into city limits. Going up a hill there's a two lane that turns into a three lane. But of course, just before it opens up to three lanes, the limit drops to 30. Near the top of the hill I got caught doing 42.

I got a ticket for every one of them. The JCPD doesn't give me warnings.

You'd think the theme would be to stop chronic speeders and dangerous lane changers, not people who normally don't speed.

I saw a Squad hiding on a downhill out of town with another with two officers at the light, on a turn-in to a football field at the top of the hill and I said to my passenger - 'Gee, all they have to do is go sit at a traffic light and they'll catch 3 violations per minute. They've been manning this downhill stop all day and I don't think they've moved an inch - nobody's speeding here.' (We had gone by a couple times shopping and I noted where they were pulled in. Traffic was heavy so no speeding was possible.

Go figure. Instead of stopping speeding, they use it for revenue generation and warrantless searches (as in roadblocks to check vehicle safety). It's just like 'no duty to protect'. They are in traffic with 'no duty to make traffic safer'. In fact, one might say they contribute to making traffic a lot more hazardous buy ignoring violators and (themselves) ignoring traffic laws (special privileges).

oh no, catching speeders is a HUGE revenue generator around here. Why else would they drop the speed limit 20 mph in the middle of nowhere just because you crossed a border?

Not to mention the infamous and hated speed camera they have on US 11E. Nobody is ignorant of the fact, or thinks it's a coincidence, that it just so happens to sit directly between the interstate and Bristol Motor Speedway. What better way to bring in revenue than to mail out of towners a ticket for speeding!?

I'm glad to hear of good old fashioned servant style PD.

I got a ticket for 13 over,...... while doing approx 2.5 under. This was pre ccw.

Thinking about your deal, Outdoorsman.....

1) Small town environment. I am guessing PD is comprised of locals? Correct assumption? Please advise.

2) this ^ has afforded opportunity to have a positive relationship with them. A good rapport.

I have it from a trustworthy friend that a local department here in the Fox Cities only brings in non-local recruits. Don't want any officers having any sympathy for any residents of the town they police. Can anyone add any info/experience from their locale?

Someone posted recently something about hearing some scanner traffic of a car stop which contained dispatcher saying "caution, ccw..." or something like that. I don't plan on volunteering, upon any future shakedown, er, I mean, traffic stop. I am curious if the DOJ is keeping to it's "promise" to maintain list/info as they are supposed to.

Oh, and no seat belt? Whew, my co-worker just got a ticket, especially for that. A whopping ten dollar forfeiture. The world is now a safer place.
