Cops and prosecutors lying as usual to harm a law abiding citizen based only on his lawful exercise of a constitutionally protected right. Cops for the most part will speak out of one side of their mouth in support of our 2A, while chastising us for exercising our 2A out of the other side of their mouth.

What is most disturbing is that judges continue to permit these documented unlawful abuses of the citizenry.

Except in Philadelphia, no license is required in order to carry a firearm openly on one’s person.

Hicks also invokes his constitutional right to keep and bear arms, guaranteed under the Second Amendment to the United States Constitution and Article I, Section 21 of the Pennsylvania Constitution. See U.S. CONST. amend. II (“A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”); PA. CONST. art. I, § 21 (“The right of the citizens to bear arms in defence of themselves and the State shall not be questioned.”). Although the right to keep and bear arms serves as an important conceptual backdrop to numerous legal issues surrounding firearms and the enforcement of the criminal law, our analysis will not focus upon the contours of that right. The issue presented is one of law enforcement practice, and the constitutional right at issue is the freedom from unreasonable, warrantless seizure of the person for purposes of criminal investigation. As such, this case is governed by the Fourth Amendment’s Terry doctrine, not by the right to keep and bear arms.
If these wusses, that hold themselves out a judges, had addressed the issue constitutionally they would have had to shoot down the state statute exempting Philadelphia.
