There are lots of technical problems with this. We are going through some of the same herky jerk in Washington with
initative 594 to the voters this November.
The problems or unintended consequences are mostly with enforcing the law if it becomes passed.
How do you ensure two private citizens making a private transaction comply? (rhetorical question)
This creates an honor system so to speak, and I lost all of my firearms in a tragic boating accident last fall. (prove I didn't)
So lets say you are willing to comply with the law and take your private transaction to said dealer and perform the trasfer. The dealer has to take the firearm into their inventory do the background check and .....if the buyer passes transferr the firearm from dealer inventory to the purcahser.
What happens if there is a hold or denial?
Ok I will just take my ole rifle back home with me.
Technically the dealer has to do a background check and paper work on the owner/seller so the firearm can be disposed from dealer inventory. (record keeping you know...government effiecnecy). Now you are the original owner and dont pass the background check what happens to the firearm?
Most people do not understand the way firearms are purchased transfered and disposed and we get these crazy laws that are supposed to make people feel good yet only succeed in more hurdles for law abiding citizens.
I'm not sure this even passes the constitutionality smell test.
