The Preemption project is landing in CDA tomorrow evening!

ISAA is leading the legal fight to force municipality to follow state law that "preempts" any municipalities anti-gun ordinance. Here is the info taken from their web site. Support the cause!

"Preemption Project

The Idaho Second Amendment Alliance began the “Preemption Project” as a means of helping Idaho cities/counties understand Idaho’s preemption law. Many municipalities have codes that are outdated and need to be brought in line with current Idaho law. Additionally, some municipalities have banned the carrying of firearms in public areas, such as parks and facilities, where they are not authorized to do so.

In order to help them correct these issues, we have researched the codes of each municipality and are in the process of sending letters to them informing them of corrections that need to be made. Some municipalities have codes that are updated or do not violate Idaho law. We will still send them a letter explaining the Idaho preemption law so that they understand their limitations on creating codes regarding firearms. We also inform them that the prohibition of carrying firearms in public areas is also not allowed under Idaho’s preemption law.

Important Public Hearings List:

Coeur d’Alene: December 16th, 2014 at 6:00 p.m. PST. The meeting will take place in the Library Community Room. The meeting can also be viewed on CDATV which is channel 19 if you are in the Coeur d’Alene area.

The following is a list of municipalities that we have sent letters to regarding codes or signs and the municipality has completed their update. TOTAL: 11

Twin Falls County, Gem County, Fruitland, Mountain Home, Burley, Emmett, Cambridge, Meridian, Twin Falls, Post Falls, Lewiston

The following is a list of municipalities that we have sent letters to regarding codes or signs and the municipality has responded to our inquiry but has not yet completed an update. TOTAL: 18

Nampa, Star, Coeur d’Alene, Cassia County, Kootenai County, Boise, Bannock County, Canyon County, Rigby, Wilder, American Falls, Hayden, Washington County, Filer, Rexburg, Ketchum, Power County, Fremont County

The following is a list of municipalities that we have sent letters to regarding codes or signs and the municipality has not yet responded to our inquiry. TOTAL: 20

Soda Springs, Kuna, New Plymouth, Salmon, Riggins, Rupert, Stanley, Troy, Genesee, Gooding, Hauser, Kimberly, Juliaetta, Plummer, Priest River, Bonners Ferry, Buhl, Cottonwood, Dalton Gardens, Fernan Lake Village

Coeur d’Alene is the only city to vote against updating their ordinance to be in compliance with state law. However, after a letter from the Attorney General’s office, they are going to re-vote on their ordinance in December 2014."

I applaud what you are doing-municipalities and counties have been reluctant at best to repeal ordinances that are unconstitutional, pre-empted or both. Many just take the approach of telling the public they are already aware of the problem but everything's ok because they just don't enforce them anymore, which is completely disingenuous. The real reason they don't repeal them is that councilmen & commissioners are loathe to propose the repeals because it would be unpopular with some of their constituents, which is completely unacceptable. I have a strong suspicion they want to keep them "on the books" just in case a new ruling or piece of legislation comes along that reinstates their validity, and further because they know they'd have a hard time convincing the present and future public to accept such ordinances anew. Same thing for Idaho's legislators, who won't propose repeals of dozens of Idaho's laws that have been held unconstitutional (especially so in the last 20 years) but they hope that someday they will get their way.

Keep doing your good work, and all my best for forcing them to do the right thing.

It is a sad state of affairs that we must force folks to obey the Supreme Law of the Land, the Constitution of these United States, and the Constitutions of our states.

Pathetic, really that they don't get thrown out of office.

New here so excuse me if this has been discussed elsewhere and I missed it. What are everyones thoughts on concealed carry (provided you have a permit) vs open carry. Thanks in advance.

"It is a sad state of affairs that we must force folks to obey the Supreme Law of the Land, the Constitution of these United States, and the Constitutions of our states." --- this would be the very same CONSTITUTIONS they all took an oath "to defended" when they were SWORN INTO OFFICE!
