Huh? UCC deals with commercial tranactions not criminal law;of course statutes can override common law, that's wht statutes are for!One more thing that might help you, this is a "low court" Not a fed court.
Under UCC thats "Uniform Commercial Code", which is what there giong by.
The "Recourse" to solve this is in UCC 1-103.6 It saids there that " A code is complimentary to the common law, which remains in force,except where displaced by the code. A staute should be construed in harmony with the common law. unless there is a clear legislative intent to abrogate the common law" (UCC 1-103.6)
Take this with you, in other words the, staute can't over ride the common law.

Common law is frequently cited, and is binding (unless statute supercedes).Common law may be the historical foundation of what we use but then so are the Hamurabic codes and I doubt that you would argue that contractors should be killed if the houses they build fall over.
